Terms of business

Terminology:

• In these conditions the "Advertiser" shall mean: Edlets.com acting as the advertisers on behalf of "The Host" in letting to "The Guests" shall mean the holidaymaker i.e.: the person who makes the booking and the other members of visiting group. "The website" shall mean www.edlets.com.

Hosts / Guests Responsibilities:

• The Host must honour all bookings if he/she/or the company has agreed to advertise either in writing (includes email), or by filling in the form on the edlets.com website or verbally. If for any reasons the accommodation is no longer available the Host must offer the guest alternative accommodation of equal or higher standard at the same price. If the Host is unable to contact the guest they must inform The Advertiser within good time so we can attempt to contact them. The Advertiser cannot be held liable by either the guest or the Host in this situation.

• Tha Advertiser provides the facility to block off dates that are already booked within the Hosts accommodation. The Host should contact edlets.com to advise of any dates that the property is unavailable (except if it is unavailable due to a booking made through edlets.com) this will block off the dates in edlets.com and no guest that previously has received an offer for a Hosts accommodation to will be able to book through edlets.com for the dates the Host has specified. If The Host does not inform edlets.com of booked dates and a booking is confirmed through edlets.com The Advertiser has the right to invoice the Host for the commission amount. In some circumstances it may be necessary for the advertiser to charge the Host for the full cost of the new accommodation + any additional expenses that have been incurred by Edlets.com for providing new accommodation to a guest. The Host agrees that Edlets.com's decision is final in all Guest and Host's disputes.

• If a guest confirms a booking through the website and the confirmed accommodation is no longer available and the Host then offers the guest alternative accommodation, the commission payment is still due to The Advertisers and will be carried on to the new accommodation. If the guest does not accept the alternative accommodation the Host will be due the commission payment to the Advertiser. If the Advertiser chooses to refund the commission payment to the guest then the Host will be due the commission to the Advertiser.  If the guest is not satisfied with alternative accommodation provided by the Host  they must inform The Advertiser within 8 hours of arrival, The Advertiser will try to source alternative accommodation of the same price and standard, if this accommodation is not accepted then The Advertiser reserves the right to retain any booking fee that the guest has already paid. In some circumstances it may be necessary for the advertiser to charge the Host for the full cost of the new accommodation + any additional expenses that have been incurred by Edlets.com for providing new accommodation to a guest. The Host agrees that Edlets.com's decision is final in all Guest and Host's disputes..

• If a confirmation is made through the website and for any reason the accommodation is no longer available as advertised,  the Host will be due the commission payment to the advertiser + 30% fine unless The Advertiser agrees to waive this charge. In some circumstances it may be necessary for the advertiser to re-accommodate the guest, if so the advertiser reserves the right to charge the Host for the full cost of the new accommodation + any additional expenses that have been incurred by Edlets.com for providing new accommodation to a guest. The Host agrees that Edlets.com's decision is final in all Guest and Host's disputes.
  
  a) If the Host has already has confirmed bookings for the enquiry period and knowingly or otherwise states that their accommodation is available and confirmation is made then this will be deemed to be the Hosts mistake and the conditions above will apply.
  
  b) If the Host enters an incorrect rate as the total charge and confirmation is made then this will be deemed to be the Hosts mistake and the conditions above will apply.

• It is the Hosts responsibility to ensure that the information provided and listed on the website is honest and accurate, legal and decent and complies with Scottish Law and that they have the owners right to let the property. If a guest is dissatisfied with the accommodation provided and the accommodation is not as advertised, the Hosts are responsible for any refunds that may be offered to the guest's including the commission payment that a guest may have already paid. The property must be furnished and contain bed linen, kitchen equipment, cooking facilities, bathrooms and all basic amenities required for a comfortable stay unless otherwise stated in the advert. The advertiser accepts no responsibility or liability for the accuracy of the adverts.  In some circumstances Edlets.com may decide to re-accommodate the guest if a property has been mis advertised if so it may be necessary for the advertiser to charge the Host for the full cost of the new accommodation + any additional expenses that have been incurred by Edlets.com for providing new accommodation to a guest. The Host agrees that Edlets.com's decision is final.

• It is the Hosts responsibility to be contactable by the guest on the day of the guest's arrival on the telephone numbers they have provided edlets. If the guest is unable to gain access to the property on the day of arrival The Advertiser will try to contact the Host on the guests behalf. If The Advertiser is not able to contact the Host on the contact numbers provided, and The Advertiser decides that the guest has been waiting for an unacceptable length of time, then The Advertiser reserves the right to offer the guest alternative accommodation. If Edlets.com decide to re-accommodate the guest and it may be necessary for the advertiser to charge the Host for the full cost of the new accommodation + any additional expenses that have been incurred by Edlets.com for providing new accommodation to a guest + 30% charge. The Host agrees that Edlets.com's decision is final. If Edlets.com chooses not to re-accommodate the guest for any reason then neither the guest nor the Hosts can hold the advertiser liable and the Host will be due a full refund to the Guest including any payments made to Edlets.com by the Guest. The Host and the guests are both advised to take out relevant holiday let insurance to cover them in this situation. 

• The Host must have consent to let the advertised property by all other parties that are involved in any way. The person, agency or any business who advertises the property will be held responsible rather than the property owner in the event of any of these terms are broken.

• A Host is due to pay the commission payment to the advertiser if the guest has not already paid us directly and in full by the date of arrival. 

• Hosts are required to quote for the full period that the guest requires. If a booking is made through the website for a longer period than the Host has quoted for then the Host will be due the extra commission payment to The Advertiser. 

• By accepting a reservation from a Guest that has been initially introduced to you by The Advertiser, The Host agrees to pay the agreed commission rate in full unless the guest has already paid it to Edlets.com. The Host is due the commission rate to the Advertiser even if they offer the guest accommodation that is not advertised on the website, The Host will be invoiced in this situation unless the guest has already paid the advertiser.

• The Advertiser cannot be held liable by the Host in the event of Guests cancellation or no show and is advised to take out relevant insurance to cover any losses that may arise from this event.

• The Advertiser does not take any responsibility for gas and electrical safety of any properties. The Host is responsible for maintaining their properties and adhering to all relevant laws and legislations.

• The Advertiser cannot be held responsible for any personal injury of holiday guests whilst in occupation of the holiday let property this is the Hosts responsibility.

• The Advertiser reserves the right to withdraw their service at anytime.

• The Advertiser accepts no responsibility for any damage in any shape or form to the holiday let property.

• The Advertiser accepts no liability in respect of damage to, or loss of, personal property.

• To maintain the integrity of The Website Hosts are not permitted to include links to other websites or telephone numbers or e-mail addresses on their property page or anywhere within the publicly accessible information they provide or within any correspondence between themselves and the enquirer.

• If the Hosts have more than 1 property and respond to an enquirer offering a different property than the one advertised they should contact the Advertiser to ask them to change the property name on the enquiry. 

• The Advertiser reserves the right to delete, modify or amend any property advertisements not adhering to these terms
  

Relationship Between Parties:

• These terms of business represent the entire agreement, duties and obligations between all involved. All previous agreements, contracts and understandings are void and terminated being replaced by this alone.

• Potential Guests Response to Adverts: The Advertiser make no warranty or promise as to the number of people that will respond to the adverts published by The Advertiser or marketed by The Advertiser on behalf The Host/or company onto the website or by email. We will accept no responsibility or liability whatsoever for any financial losses that should arise as a result of the property not being occupied by a given date. We exclude any warranty or condition in these circumstances. We will not accept the argument that this term was included as an implied term.

• The Advertisers believe all applications to view or to rent a property as a result of the viewing of an advert placed on the website by us on behalf of you, the Host as genuine. We accept no responsibility whatsoever if an application or response is deemed to be a hoax or in any way false. We accept no financial liability if this event arises.

• As we are not a party to the booking contract, The Advertiser cannot be held responsible if The Host does not honour the reservation or provides accommodation which is different from that reserved in this situation The Advertiser reserves the right to retain any booking fee that the guest has already been paid. Accordingly, we shall not be responsible for any loss, claim, cost, damage or injury, which you may incur (directly or indirectly).

• In the event that a guest cancels a booking, The Advertiser reserve the right to retain any payment that the guest has already paid. We advise all guests to take out relevant holiday insurance to cover them in the event they may need to cancel.

• The Host is responsible for all council tax bills, utility bills and building maintenance bills unless another agreement has been made prior to the booking.

Personal Injury, Death and Damage or Loss of Property:

• Personal Injury, Death and Damage or Loss of Property: We will not accept responsibility or liability in any way in the event of death, personal injury, damage or loss of property or health, incurred by you including Guests and Hostsor any legal entity that arises as a result of using this website. The personal actions of the Host, or any users of the site including private landlords, letting agencies or searching tenants in no way reflect the personal actions, beliefs or views of anyone connected with www.edlets.com. We are in no way responsible for the actions of the above mentioned.

The Role of The Advertiser and the Hosts:

• The Role of The Advertiser and the Hosts: The Advertiser do not act in any way as an agent or on behalf of those who own or advertise property on this website. We have no legal responsibility whatsoever for the personal health or safety of those who view or occupy properties that have been advertised on this website. We have no legal responsibility whatsoever for the maintenance of the properties advertised on this website. www.edlets.com is merely an online advertising tool.

• The Hiring Contract is between The Guest and The Host, and is subject to the Hosts terms and conditions. As standard practice guests may be required to pay an additional refundable security deposit against damages and make the balance payment prior to arrival. If a Host has not supplied you with terms and conditions prior to booking please ask the Host for them.
  
  Offer and Acceptance

• The contents of this website act only as an invitation to treat. The Host is invited to use the services of The Advertiser and the website by advertising the property. Acceptance of the invitation to advertise is the email or verbal request we receive by email or telephone from the Host, agent or any other person involved to advertise or market the property on the website. Then and only then, is a contract formed and these terms of business enforced.

Exterior Agreements:

• Any agreement that is made between your company, a potential tenant or a private landlord of any property that may be advertised on this website is an entirely separate contract, understanding or agreement. It does in no way affect the terms set out in this agreement. We have no legal responsibility in any such agreement.

Exterior Content:

• The Advertiser accept no responsibility whatsoever for the content or material found on exterior websites that we may provide hypertext or pictorial links to from time to time.

The Advert and the use of your information.

• The Advertiser will allow the public to access and view property information and photo's at the web address www.edlets.com

• The Advertiser shall reserve the right to advertise your property images and information on other websites and by email correspondence.

• The Advertiser shall display data in the form of adverts on the website from information provided to The Advertiser by you, The Host.

• The Advertiser reserves the right to use the Hosts photos or information on any area within the website www.edlets.com if the Host does not have permission to use the photo's listed on Edlets.com website then it will be the Host that is liable and responsible for the use of the images and any other content rather than Edlets.com

• The Advertiser allow you or your company to use our name, web address, logo and trademarks in any appropriate advertising or marketing manner that in no way is detrimental to the website or the image or branding of www.edlets.com or Discodog Ltd.

• The Host agrees to remedy and indemnify The Advertiser against any loss, damage, costs or expenses of any sort that may be incurred by us or for which we become liable as the result of the display by us of information provided by you or that we copy from your website. The Host is responsible for checking the advert and making sure the information about your property is correct and accurate and that you have the right to advertise the property and take bookings on the website Edlets.com

• Validity of Displayed Information: We will not guarantee or provide promise that the information displayed on the site will be free from mistake, error and false information or be incorrect in any way. We accept no responsibility or liability for any financial loss, loss or damage to property, or persons as a result of incorrect information that may be published on the website.

• The Hosts allow us to display the information provided, and advertise the properties to the general public in any way we see fit.

• The Host is responsible for the material, photographs and text that is published onto the Edlets.com website. If Edlets.com suspect any fraud has been committed then we reserve the right to provide information to any organisations or bodies that we see fit.

Accuracy of information:

• edlets.com does not act as estate agents or travel agents. We simply provide a service for Hosts to display rental accommodation on this website. We do not take part in, or responsibility for, booking arrangements or any property management issues.

• All property information is provided in good faith, however as the property information is given to us by the Hosts the advertiser do not warrant that the information provided is accurate.

• The contents of the Website do not constitute advice and should not be relied upon in making or refraining from making, any decision.
  

Down Time and System Errors:

• At certain times and often without warning, influences beyond The Advertisers control may mean the service becomes temporarily out of use. We do not warrant that the site will be free from error or that the website and server computer are free of computer viruses or other harmful applications.

Call recording and email monitoring

• We may monitor and record phone calls and messages sent via email or via our messaging system. This is done for training purposes and to help us improve our service. We may also use call recordings or emails as evidence in the event of a dispute or if we suspect any fraud may have been commited.

Financial Agreement:

• Financial Agreement - This service of uploading of property adverts by us is at present a free one and will remain so without change until at least August 2012. If, after this time, however the management and owners of the site deem it necessary to charge for this, this can be done with 28 days prior notice. If this situation does arise and the notice is communicated from us to you the advertiser, then you have 28 days to decide whether to continue to use the website or withdraw from this agreement. At no time will funds be requested for the registration as a user, or for the adverts published before the date of notice.

• Data Changes: This service of minor changes to your advert by us is at present a free one and will remain so without change until at least August 2012. If, after this time, however the management and owners of the site deem it necessary to charge for this, this can be done with 28 days prior notice. If this situation does arise and the notice is communicated from us to you the advertiser, then you have 28 days to decide whether to continue to use the website or withdraw from this agreement.

Changes in Terms of Business:

• Changes in Terms of Business: We reserve the right to alter or amend these terms of business at any time. Continued use of this service after the changes have been made will constitute acceptance of the altered terms

Legality:

• The law of Scotland: These terms of business shall be governed and construed in accordance with the law of Scotland. The agreement will be subject to the exclusive jurisdiction of the courts of Scotland.

Invalid Terms:

• In the event that any term of this agreement if found to be invalid, illegal, unlawful or unenforceable, it shall not affect the enforceability of any of the remaining terms.
